TERMS OF SERVICE & CONTACT CONSENT AGREEMENT

INTRODUCTION

These Terms of Service and Contact Consent Agreement (“Agreement”) govern your relationship with Vintage Modern INC (“Company,” “we,” “our,” or “us”), a company based in Buford, Georgia, USA, providing modernized vintage classic automobiles to customers internationally.

ELIGIBILITY

By using this form and agreeing to these Terms, you represent and warrant that:

  • You are at least 18 years of age.
  • You possess the legal authority, right, and freedom to enter into this Agreement and to form a binding agreement.
  • You are not a minor in the jurisdiction in which you reside.
  • You will not use our services for any illegal or unauthorized purpose.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.

CONTACT CONSENT

By clicking the “Submit” button on this form, you expressly consent and agree to:

  • Receive communications from Vintage Modern INC, including but not limited to text messages, phone calls, and emails regarding our products, special offers, updates, and other company communications.
  • Be contacted by our representatives at any time and with no predetermined frequency. All communications will be made by real people; we do not use automated dialing systems, pre-recorded messages, artificial voice technology, or auto-texting systems.
  • Receive these communications at the phone number(s) and email address(es) you have provided, even if the phone number is on a corporate, state, or national Do Not Call Registry.
  • If you resubmit this form at any time, you acknowledge and agree that this constitutes a new opt-in and will restart all communications, including text messages, phone calls, and emails, regardless of any previous opt-out request. Each form submission represents a fresh consent agreement under these Terms.

This consent is not required as a condition to purchase any goods or services from Vintage Modern INC.

INTELLECTUAL PROPERTY

All photographs, product images, descriptions, and marketing materials created by or for Vintage Modern INC are the exclusive property of Vintage Modern INC and may not be used, reproduced, distributed, or displayed without our express written permission.

VEHICLE PURCHASE TERMS

Detailed terms regarding vehicle purchases, including payment terms, delivery, warranties, and financing options, will be provided in a separate Vehicle Purchase Agreement at the time of purchase. Nothing in these Terms of Service shall supersede or replace the terms of the Vehicle Purchase Agreement.

TERMINATION

Either party may terminate this Agreement at any time:

  • You may terminate this Agreement by emailing shop@vintagemodern.co with your request to terminate
  • Vintage Modern INC reserves the right to terminate or suspend your access to our services immediately, without prior notice, for conduct that we believe violates this Agreement or is harmful to other users, us, or third parties, or for any other reason at our sole discretion

OPTING OUT

You have the right to withdraw your consent to receive communications from us at any time. To opt out:

  • For text messages: Reply “STOP” to any message from us
  • For phone calls: Inform our representative that you wish to opt out of future calls
  • For emails: Click the “Unsubscribe” link in any of our emails or reply with “UNSUBSCRIBE” in the subject line
  • For all communications: Contact our customer service at the contact information below and request to be removed from all communication channels

We will process your opt-out request promptly, but please allow up to 10 business days for the changes to take effect across all our systems.

GENERAL PROVISIONS

  • Force Majeure: Neither party shall be liable for any failure of or delay in performance of its obligations under this Agreement to the extent such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, acts of government, flood, fire, earthquakes, civil unrest, acts of terror, strikes or other labor problems, or Internet service provider failures or delays.
  • Modifications to This Agreement: Vintage Modern INC reserves the right to modify this Agreement at any time. We will notify you of any significant changes via email or through a notification on our website.
  • Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.
  • Dispute Resolution: Any dispute arising out of or relating to this Agreement shall first be attempted to be resolved through good-faith negotiation. If such negotiation fails, both parties agree to submit to binding arbitration in Gwinnett County, Georgia.
  • Limitation of Liability: In no event shall Vintage Modern INC be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.
  • Indemnification: You agree to defend, indemnify, and hold harmless Vintage Modern INC and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses.
  • Severability: If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
  • Entire Agreement: This Agreement constitutes the entire agreement between you and Vintage Modern INC regarding the subject matter hereof.
  • Electronic Signature: Your use of our services and clicking the “Submit” button constitutes your electronic signature, which has the same legal effect as a physical signature.
